Position: TOT Expert to develop Training Manual on Investigation and Prosecution of Juvenile Justice.
Location: Hargeisa Somaliland
Application Deadline: 15- August – 2021 (14:00hrs East African Standard Time)
Duration of Initial Contract – 2 Months.

1. Background

Article 103 of the Constitution of the Republic of Somaliland states that the Attorney-General and the Deputies make up the Procuracy. In addition, Article 99 declares that the Judiciary is composed of the Courts and the Procuracy. Article 107 identifies the Attorney-General as a member of the Judicial Commission and Article 113 states that the Procuracy is one of a number of Special Organs of State. Somaliland Office of Attorney, vision is “a just, secure and stable society. services to ensure and improve prosecution of criminal cases, following by the Somaliland Constitution and International standards of Human Rights. Which reflects NDP II – SDG16.

AG office established Specialized prosecutors for SGBV and Juvenile Unit across 6 regions. This unit is established to give special consideration for the Juvenile cases following Somaliland Juvenile Justice LAW (Law no 36/2007) and to protect the rights of Juvenile conflicted with the law. Specialized prosecutors get training, but there is no training manual, Standard operation Procedure and other any other guidelines.

UNDP supports to develop and improvement of SGBV and Juvenile Unit under the UN Joint Rule of Law Programme 2020 – 2021. The Programme is in-lined with and in furtherance of the outcomes and results envisaged in the Somaliland NDP-II Pillar 3- Good Governance, and sub-sectors of Rule of Law and Security. (Somaliland aspires to build a state where all citizens are equal before the law, and where the rights of every citizen are protected by the law and law enforcement agencies, without discrimination based on ethnicity, clan, color, religion, gender, age, political affiliation or belief).
This assignment falls with the Framework UN joint Rule of Programme and Somaliland Office of Attorney General. It intends to develop the capacities of prosecutors, police and courts to enable them to fully applied Juvenile justice law and to improve in the practices of the administration of Juvenile justice cases.

2. Duties and Responsibilities

The TOT Expert will work in collaboration with relevant staff of UNDP, and justice sector institutions in Somaliland as well as consult relevant in-country and international partners, UNICEF, UNODC etc- during the development of the Training manual. He/she will conduct through research of the existing Juvenile related policy and legal framework in Somaliland and other resource materials relevant to the management of Juvenile cases.

The manual will cover the details of the various topics/chapters which include but not limited to the following.

• Introduction to Juvenile Justice System
• International instruments relevant to Juvenile Justice Administration
• Somaliland Legal Framework of Juvenile Justice
• Investigation the Juvenile offenders
• The role of probation officer
• Pre-trail hearing
• Diversion
• Prosecution and trail preparation
• Conclusion and General recommendations.

2.1. Key Tasks

The TOT expert will execute the following tasks;
• Consult with the Attorney General to set the contents of the training Manual;
• Consult the UNDP and other relevant authorities concerned the Juvenile Justice including Police, Related Ministries, UNICEF and UNODC.
• Prepare a draft of Training Manual on Investigation and Prosecution of Juvenile Cases.
• Facilitate Consultation workshop on the training manual;
• Facilitate validation workshop on the training manual;
• Submit the final draft to the office of Attorney General;

3. Timing and Duration

The assignment will be completed in 2 months from commencement. The expert needed to prepare the schedule and approved by the Attorney General.
The payments are subject to delivery of satisfactory products and results.

4. Required Qualification, Skills and Experience
4.1. Education:
• Bachelor’s degree in Law, Political Science or Development studies from a recognized University;
• Demonstrate excellent command of Spoken and Written English;
• Excellent interpersonal and diplomatic skills.
4.2. Experience:
• Minimum 8 years of relevant experience of working with rule of law institutions or criminal justice system.

• Experience in working with specialised law enforcement units/departments on Juvenile;
• Demonstrate practical experience in development of training manuals, standards and guidelines for institutional capacity building in relevant areas;
• Experience in developing training methodologies and facilitation of large and small group;
• Demonstrated experience in working with a variety of stakeholders from all key stakeholders;
• Basic Juvenile understanding, skills, experience and commitment;
